These Terms & Conditions apply to your use of this website (https://neargatten.co.uk) and to any booking you make at Near Gatten Fishery, Near Gatten, Ratlinghope, Shrewsbury, SY5 0SN (“the fishery”, “we”, “us”). By using this website or making a booking, you agree to be bound by these Terms, along with our Privacy Policy and our Lake Rules.

2. Use of This Website

This website is provided to give you information about the fishery, our facilities, pricing, and availability, and to allow you to make enquiries and bookings. You agree to use this website only for lawful purposes and not to attempt to disrupt, interfere with, or gain unauthorised access to it.

We aim to keep the information on this website accurate and up to date, but we do not guarantee that pricing, availability, or other details are error-free at all times. Where a genuine error affects a booking (for example, an incorrect price), we will contact you before proceeding and you will have the option to cancel.

3. Bookings & Payments

All bookings for sessions, swims, and lodges are made through swimbooker, a third-party booking platform. When you make a booking, you also agree to swimbooker’s own terms of service and payment terms, which govern the booking and payment process itself.

No angler may fish at Near Gatten without a confirmed booking made in advance. Anglers arriving without a confirmed booking may be turned away.

4. Cancellations & Refunds

Cancellation and refund requests are handled in line with swimbooker’s booking terms at the time of your booking, as swimbooker processes the booking and payment on our behalf.

Separately, if you are asked to leave the fishery during your visit due to a breach of our Lake Rules, no refund will be issued for the remainder of your session, in line with the Lake Rules.

5. Lake Rules & Conduct

All anglers must comply with our Lake Rules at all times while on the fishery. The Lake Rules are incorporated into these Terms by reference and are available here:

In particular, and without limiting the Lake Rules:

All anglers must hold a valid Environment Agency rod licence
Anglers under 16 must be accompanied and supervised by a responsible adult at all times
Anyone found in breach of the Lake Rules may be asked to leave the fishery immediately

We reserve the right to refuse entry, or to ask any angler or visitor to leave, if their conduct puts the welfare of the fish, the fishery, other anglers, or themselves at risk.

6. Assumption of Risk & Liability

Fishing, and visiting a fishery generally, carries inherent risks, including but not limited to deep or uneven ground, water hazards, weather conditions, and the use of hooks and other angling equipment. By visiting the fishery, you accept these risks as part of the activity.

To the fullest extent permitted by law, Near Gatten Fishery accepts no responsibility for loss of, or damage to, personal property, equipment, or vehicles while on the premises, and accepts no liability for injury except where this results from our own negligence.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be limited or excluded under English law.

7. Intellectual Property

All content on this website, including text, images, logos, and design, is owned by or licensed to Near Gatten Fishery and may not be copied, reproduced, or used without our permission, except for your own personal, non-commercial use.

8. Third-Party Services

This website uses or links to third-party services, including swimbooker (bookings), Google Maps (location), and a third-party weather widget (live conditions). These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your visit to the fishery will be subject to the exclusive jurisdiction of the courts of England and Wales.
